1. Introduction & Ecosystem Scope

Welcome to Luvia Universal OS ("Luvia", "Platform", "We", "Us", or "Our"). These Terms of Use & Service ("Terms") govern your access to and use of all websites, software, applications, APIs, and services operated by Luvia, including but not limited to:

Luvia Universal OS (luvia.page) & Luvia Account Hub (account.luvia.page)
Luvia Forms & Election Engine (forms.luvia.page)
Luvia Pix Image Studio (pix.luvia.page)
Luvia Android Companion Applications & Extension Services
Social messaging form integrations (WhatsApp Business & Telegram Bot APIs)

By accessing, registering for, or using any part of the Luvia ecosystem, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our services.

2. Description of Services & Four Specialized Form Modes

Luvia Forms provides an all-in-one form builder, electoral governance, live webstream polling, and zero-knowledge anonymous submission platform across four core operational modes:

Mode 1: Standard Forms & Surveys

General data collection, lead generation, intake, and feedback supporting 35+ field types, AI Form Architect generation, conditional logic, and payment elements.

Mode 2: Cryptographic Verifiable Elections (Secret Ballot System)

Organized voting and governance. Voter identities are authenticated prior to ballot issue, but vote payloads are cryptographically detached upon submission to ensure 100% secret ballots. Voters are issued a detached receipt verification hash proof (0x...) to independently verify their vote was tallied.

Mode 3: Live Polls & Interactive Quizzes

Real-time Presenter Mode, live dynamic chart streams powered by Cloudflare Durable Objects, timed trivia, and bot anti-cheat protection.

Mode 4: Zero-Knowledge Encrypted Anonymous Vaults

End-to-end client-side AES-256 encrypted disclosures (Whistleblowing, Intimate Confessions, Team Grievances, Therapy Intake). Submissions are encrypted on the respondent's device using the Form Owner's public key. Only the Form Owner holding the private key can unseal data.

3. Accounts, Identity & Workspace Security

To access builder tools and workspace features, you must register a Luvia Account via Single Sign-On (SSO) or verified email authentication.

Account Responsibility: You are solely responsible for maintaining the confidentiality of your account credentials, workspace access tokens, and private decryption keys.
Workspace Team Roles: Workspace Owners are responsible for assigning appropriate permissions (Owner, Editor, Viewer, Auditor) to team members. Luvia is not liable for unauthorized actions taken by users invited to your workspace.
Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive activities.

4. Acceptable Use Policy & Content Conduct

You agree not to misuse Luvia services. Prohibited conduct includes, but is not limited to:

Creating forms for malicious phishing, credential harvesting, or malware distribution.
Interfering with or attempting to bypass electoral anti-cheat mechanisms, rate limiters, or single-use voter tokens.
Publishing non-consensual personally identifiable information (PII), hate speech, or content promoting illegal acts.
Attempting unauthorized access to Luvia's edge infrastructure, databases, or third-party workspaces.

18+ Adult & Sensitive Confessions Policy

For form presets designated under Adult Confessions or Sensitive Intake categories, Form Owners MUST enable the 18+ Age Verification Gate modal. Luvia strictly prohibits child exploitation material, non-consensual imagery, or illegal content. Violations will result in immediate permanent account termination and referral to law enforcement.

5. Cryptographic & Zero-Knowledge Vault Disclaimer

In Mode 4 (Zero-Knowledge Vault Encrypted Forms), submissions are client-side encrypted before network transmission. Luvia servers store only encrypted ciphertext blobs and store zero decryption keys.

Key Loss Warning: If a Form Owner loses or corrupts their private decryption key or passphrase, Luvia support staff CANNOT recover, unseal, or reset the encrypted vault data. You acknowledge and accept full responsibility for safeguarding your cryptographic keys.

6. Subscriptions, Payments & Billing Terms

Luvia operates a hybrid monetization model comprising Luvia Free, Forms Standalone PRO, and Luvia Universal PRO subscriptions.

Payment Processors: Transactions are billed via PCI-DSS Level 1 compliant processors (Paystack for NGN card, bank transfer, and USSD payments; Paddle for international billing).
Auto-Renewal: Paid subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless canceled prior to the renewal date.
Cancellation & Refunds: You can cancel your subscription at any time via the Luvia Billing Portal. Subscription fees are non-refundable except where required by applicable consumer law.
Luvia Universal SSO Pass: Active Luvia Universal PRO subscribers automatically receive unlocked PRO access across Luvia Forms, Luvia Pix, and all ecosystem micro-apps without separate billing.

7. Intellectual Property & Data Ownership

Your Content: You retain full ownership of all forms, survey questions, branding assets, and submission responses created on or collected via Luvia. You grant Luvia a limited, non-exclusive license strictly to host, transmit, and display your content to deliver the service.
Luvia IP: All platform software, edge worker code, UI components, AI Form Architect models, design tokens, trademarks, and logos are the exclusive property of Luvia Universal OS.

8. Service Availability & Limitation of Liability

While Luvia strives for 99.99% edge service uptime, all services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Luvia disclaims all warranties, express or implied.

In no event shall Luvia be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data loss, or electoral disputes resulting from improper configuration of voter rolls or lost private keys.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or Luvia services shall be resolved through binding individual arbitration or designated competent courts.
